Solution
Golden Ring – Compliance is the software application carried out by TESI SpA for the management of the mentioned problems, able to support the company with no impact on the existing processes. The application, which is based on a Business Process Management instrument, is easily suitable to the company organization allowing a performing economical management of the related activities.
This solution allows the manager in charge or the company department to do the following:
- describe the organization processes and risks mapping
- support manager and company departments in charge activities
- related documentation management and storage.

Main Italian laws and recommendations
- Legislative Decree 231/2001 (Corporate administrative liability): The decree law brings in a kind of company liability when crimes against the Public Administration or the corporation are committed in favour of the company itself.
- Law 262/2005 (recommendations for savings protection and financial markets regulation): this law introduced numerous news about the governance of the Italian companies, forcing them to elect the manager in charge of preparing and certifying accounting and corporate documentation. The same manager is also in charge of certifying the clearness and the adequacy of the financial information, of the balance sheet and, in general terms, of the accounting and administrative procedures.
- Legislative Decree 196/2003 (set-of-rules about personal data protection): the new Consolidated Act about privacy, forces companies and institutions to organize a management system for personal data protection and to certify it with the specific reporting (DPS).
- Legislative Decree 81/2008 and ex Legislative Decree 626/94 (safety and health on workplace): recent norm evolutions have deeply modified liabilities related to safety on workplace. Specifically manslaughter and severe injury crime connected to safety on workplace have been added to the Legislative Decree 231/01.
- BCM (Business Continuity Management): mapping of company risks, processes and relevant backup in order to guarantee the company operation continuity. The set-of-rules also previews the identification of the instruments needed to ensure the company activities safeguard.
